General

These general contracting conditions together with the particular conditions that may be established will regulate the commercial relations between TECNOLOGÍA MARINA XIMO S.L. (MAREXI) and the user who makes purchases through the website.

These conditions have been drawn up on the basis of Law 34/2002 on Information Society Services and Electronic Commerce (LSSI), Royal Legislative Decree 1/2007, of 16 November, which approves the revised text of the General Law for the Defence of Consumers and Users and other complementary laws and any other regulations applicable to on-line purchases in Spain.

The purchaserof the online shop must be at least 18 years of age to be a user of the online shop.

Purchasing procedure

The MAREXIbrand products offered in the shop will be described with their characteristics, price and a photograph of them.

Once the user has placed the order, the online shop automatically registers the order and sends a confirmation email.

Prices

The prices reflected at the time of purchase by the user do not include taxes.

Taxes and shipping costs will be included during the purchase process if any.

Payment systems

Tecnología Marina Ximo S.L. accepts the following payment methods for purchases through this website:

Payment by credit card: VISA, MASTERCARD.

We guarantee that each of the transactions made on our website is 100% secure. All operations involving the transmission of personal or bank details are carried out using a secure environment. We use a server based on the standard security technology SSL (Secure Socked Layer). All the information you transmit to us travels encrypted through the network.

Likewise, your credit card details are not recorded in any database, but go directly to the bank’s POS (Point of Sale Terminal).

Credit card fraud is a crime and TECNOLOGÍA MARINA XIMO S.L. will take legal action against anyone who carries out a fraudulent transaction in our on-line shop.

Delivery of the products

Delivery will be made within approximately 3 working days in mainland Spain from confirmation of payment of the order.

For other destinations the delivery time will be less than 6 working days, although to find out the specific date you can contact info@marexi.com.

Delivery times may be longer during holiday periods (summer, Christmas and/or Easter).

For deliveries to the Canary Islands, Ceuta, Melilla, Azores, Madeira, outermost regions and countries outside the European Union, please contact info@marexi.com.

In the event that delivery cannot be made for any reason, TECNOLOGÍA MARINA XIMO S.L.will contact the user in order to agree on a satisfactory solution.

Promotions

The advantages offered in the different promotions will be subject to the availability of the promoted product at that moment.

Product warranty

The PINGER product warranty covers its entire useful life (one year from delivery).

Defects caused by negligence, knocks, improper use or manipulation of the product are not covered by the warranty.

Likewise, the warranty does not apply if the defects in the device have been caused by damage during transport not carried out by the manufacturer or any of the logistics operators, as well as by incorrect installation or assembly, or by improper storage of the product.

In case of defective products, the seller must proceed, as appropriate, to repair, replacement, price reduction or termination of the contract, corrective measures that will be free of charge for the consumer and user.

Limitation of liability

Product liability is governed by Royal Legislative Decree 1/2007, of 16 November, which approves the revised text of the General Law for the Defence of Consumers and Users.

Applicable legislation and jurisdiction

The legislation applicable to on-line purchases through this portal shall be that of Spain. For any question relating to the on-line purchase, the legal jurisdiction will correspond to the judges and courts of the user’s domicile. However, for those cases in which the regulations foresee the possibility for the parties to submit to a jurisdiction, TECNOLOGÍA MARINA XIMO S.L. and the User submit, at their choice, to the courts and tribunals of the user’s domicile for the resolution of conflicts and renouncing any other jurisdiction.

Cancellation policy

Within 24 hours of placing your order, as long as it has not been dispatched from the facilities of TECNOLOGÍA MARINA XIMO S.L., you can request cancellation of your order by sending an email to info@marexi.com, indicating your name, address, telephone number, etc. Within a maximum period of 10 days the amount of the purchase will be refunded by the same means of payment used.

Returns policy

Users may exercise their right of withdrawal during a period of 14 calendar days from the date of delivery of the product; that is, their right to return the products purchased without the need to give any justifiable cause and without incurring any penalty.

In all returns, the user will be paid the total amount of the returned products. However, the initial shipping costs will be deducted from this amount.

In the event that the return takes place as a result of a product defect or an erroneous shipment, TECNOLOGÍA MARINA XIMO S.L. will bear all the costs arising from it.

The return will be rejected when the products are damaged during the return process as a result of inappropriate packaging assumed or carried out by the user himself.

Procedure for returning an order:

Step 1: To request a return, the user must contact info@marexi.com ,indicating the products they wish to return.

Step 2: The TECNOLOGÍA MARINA XIMO S.L. Customer Service Department will contact the user to coordinate the return method, the cost of which will be paid by the user.

Step 3: Once we have the product in our facilities, and after checking the product, we will proceed to refund the amount, with the corresponding deductions if applicable.

The refund will be made using the same payment method used by the user. The refund will be effective within a maximum period of 14 calendar days from the date of the request for return of the order by the consumer and receipt of the product at the facilities of TECNOLOGÍA MARINA XIMO S.L.
